Like bullets out of a gun

Today we found out... it was a .45 that he used, he only fired 2 shots (both of which hit) and that Ruby was more than likely not moving when he shot at her.

In most residental areas the firing of a .45 is considered a felony and also if you can't get him on any charges on the dog then do to the fact that David was outside with the dogs then you can possibly charge him with attempted murder and also reckless endagerment. Take photos of where the incident occured therefore he can't say the dogs were attacking him or on his property.

Just go after him for firing a firearm in a residential area, there?s not a lot you can do about him shooting the dog regretfully, animal cruelty laws are pretty lax, tops is a year in prison or a fine, which he more than likely won?t get (except he did shoot BOTH dogs? so that my help).

In order for a .45 to leave such a small hole as the one in the picture you showed before? there had to have been a LOT of distance there, and she must have been standing still in order to get that shot. Try to press that when this goes to court? he HAD to have been standing there AIMING his gun to make that shot and there had to have been a lot of distance there.

unfortunately, we are not within city limits and it is totally legal to shoot guns as often as you like.

As the above people have said. For Ruby to have been shot between the eyes (and the other factors in the shot) he had to have been taking aim.
Their is no way, that in a panic, a man (under any circumstances) could hit 2/2 and that straight on with one.
Plus, how random is it, for your neigbhor to just be walking down the drive holding his .45?? Not many people go to get their mail carrying their gun.
Stress the common sense in all of this. In the end, if their isn't much evidence, common sense will rule.

Even if it's legal to shoot guns out there, it's not EVER legal to shoot a handgun toward someone else's property (like your land/home/dog), he did break several laws by doing that.

Well.
Here are some suggestions you mgiht want to file a complain with the law enforcment agency, or the Game and Hunting Agency.
It is Illegal to hunt (Kill an Animal) on your property that is is not your own. Thus. Shooting the Dogs on your property is Unlawfull Hunting (Which might get his gun licence removed)
Secondly, He shot at a Human and thus endangered the life of citizen (Yor Husband was Outside at the Time and I assume the dogs were between Him and the Shooter)
This might carry a jail time, as well as a stiff fine.
You can seek to sue him for destruction of private property. As the Dogs were your possession on your land, and cost money to own (Same deal if he shot your car)
You can also sue him for pain and suffering you endured because of the Dogs death.
You can sue him for the pet bills and damage done to the surviving dog. All Vet fees, etc.
Sue him again for Failure to warn or allow your husband/Significant other to take cover.
Sue Him again for poaching on your property.
Sue Him again for failure to dispose of the Dogs appropertly. (He did not clean up his mess, he shot the dogs on your land and then left them there to rot)

It's not about the problems you might face with being able to inflict legal charges against him.
Sue him where it hurts the most, His money and his finances.
If you can sue him for everything he owns.
That will hurt him more then anything else.
Call a Lawyer, and start cases againt him.
That would be my best advice.
